Gym Partner Terms
Version 2026-10-08
For gyms that list courts on Court Market, operated by HS Tech. Players and trainers who book are covered by the Terms of Service.
Placeholder: requires review by a qualified attorney before launch.
What these terms must cover
For counsel to draft
The final Gym Partner Terms need to cover, at least:
- The 12% platform fee — what it’s charged on (the booking price; on a partial refund, the amount kept), and when it can change.
- Payout timing — when a booking’s payout is released, holds while a problem is reviewed, reversals after refunds or card disputes, and Stripe’s role.
- Cancellation obligations — the gym’s duty to honor bookings, the full refund owed when a gym cancels, and consequences of repeated cancellations.
- Liability and waivers — responsibility for the facility and for injuries, and whether the gym’s own waiver applies to Court Market customers.
- Insurance — any insurance the gym must carry. Court Market does not provide insurance.
- Taxes — who is responsible for sales and other taxes on bookings, and tax reporting of payouts.
- Disputes — customer problem reports and no-show disputes, card chargebacks, and disputes between the gym and Court Market.
- Suspension — when Court Market can suspend or remove a gym or a listing, and what happens to existing bookings and payouts.
How it works today
Until counsel’s terms replace this page, this is how the product currently works, for reference:
- Verification. A gym can take bookings once Court Market has approved its verification application, it has set up payouts with Stripe, and it has a court with published availability.
- Prices and the fee. The gym sets its prices; customers pay exactly the listed price. Court Market’s fee is 12% of the booking price, so the gym is paid 88%. When a customer cancels with a partial refund, the gym is paid 88% of the amount kept.
- Payouts. A booking’s payout is sent to the gym’s Stripe account 24 hours after the booking ends, unless a problem report or no-show dispute is open, in which case it waits for the outcome. Stripe then pays out to the gym’s bank on the gym’s Stripe schedule.
- Cancellations. The gym picks one of three cancellation policies. If the gym cancels a booking, the customer is refunded 100%, and the cancellation is recorded on the gym.
- No-shows. A gym can mark a booking as a no-show within 48 hours of its end. The gym is still paid. The customer can dispute it, and Court Market reviews it.
- Reviews. Customers review completed bookings; the gym can respond publicly once per review.
